Dee Doctor (Thailand) Company Limited (“Company”, “we”, “us”, “our”) will collect information related to individuals (“Personal Data”) in providing our application (“Platform”) products and services related to the Dr.Dee App (collectively, the “Services”). We consider the protection of Personal Data to be one of the most important management issues as a responsibility of an Internet content service company. We will act in compliance with the laws and regulations applicable in countries and regions where we are conducting business (such laws and regulations are hereinafter collectively referred to as the (“Applicable Laws”) and will make efforts to properly protect Personal Data based on this Privacy Policy (this “Policy”).
The Scope of this Policy
This Policy shall only be applicable to the Personal Data processing undertaken directly by the Company in the provision of Services by us to You through Dr.Dee App and Dr.Dee Partner App or through other communication channels. This Policy shall not be applicable to the process of the Personal Data by any other third-party, even those third-party services are connecting from the Platform or relate to the Service (including, but not limited to, the processing of Personal Data by our merchant partner that registers to offer service to you through our Platform (the Partner). It should be noted that the Company does not have any ability to control the Personal Data processing undertaken by those third party; therefore, it is highly recommended that the User should study the relevant privacy notices of those third-party that are separate from this Policy.
Personal Data to be collected
“Personal Data” means any information pertaining to data subject, or enables the identification of data subject, whether directly or indirectly.
Personal Data that the Company collects, uses and/or discloses may be vary in accordance with the scope of service that you or user use or your other interactions with the Company, shall include but not limited to the following Personal Data
• Identification information (e.g., name, gender, date of birth and any other Personal Data provided for the user account registration, including username and password)
• Contact information: address, e-mail, phone number, User’s social media account (i.e., LINE ID, Facebook Account / Google Account); and in case where the User use delivery Services, this contact information shall include the delivery address.
• Usage information of services: device’s IP address, log-in information, browser type and version of program which user use to access the Platform, time setting, location and operating system.
• Financial information (e.g., payment transaction, credit card information, bank account information payment slip or other proof of payment of any Services fees)
• Service behavior information including the history of using our services and products;
• Information necessary for complying with the laws, including information for investigation and use of any relevant actions in the event of any breaches of the terms of services or any unlawful acts.
Legal basis
It is necessary for the Company to collect, use, or disclose the above-mentioned data on the legal basis to perform our contractual obligations with you, to comply with the requests of data subject prior to the effectiveness of such contractual obligations, to comply with applicable laws, or as necessary for lawful interests of the Company. If you do not provide personal data as required, the Company may not be able to provide services or proceed your requests.
Source of personal data
Company may receive your Personal Data from the following sources:
4.1 Information collected from User’s Personal Data by the system upon your visit to the Platform;
4.2 Information collected from the Personal Data from User through various channels, including (a) the contact made through various channels which the Company may have; (b) the user registration on the Platform; or (c) the participation in the Company’s promotional activities;
4.3 Information collected from your submitted survey, send-receive emails, short messages (SMS), or other communication channels between you and the Company;
4.4 Information collected before or during your participation as business partner, partnership, or party to a contract with the Company;
4.5 The Company may receive your personal data from other sources not directly from you where such source has the right to disclose your personal data as permitted by laws such as government sectors, subsidiary companies, business partners and subcontractors that have been trusted by the Company to register and provide services to you.
Purpose of Collection, Storage, Usage and Disclosure of Personal Data
The Company shall collect, use and process User’s Personal Data for lawful purposes without causing excessive impact on the User’s right as the data subject. Thus, the Company shall process the defined Personal Data for the following purposes:
5.1 To perform data analysis for the services, marketing activities of the Company and partners, which the Company is a contracting party or having legal relations;
5.2 To inform and offer privileges, information, news, promotions, special privileges, discounts, special offers, advertisements, notifications and other deals related to the Platform of sell and purchase of products or services of the Company, including but not limited to any legal entities, partnership groups which the Company is a contracting party or having legal relations, through emails, short messages (SMS), applications, social media, mobile phones, etc.;
5.3 To apply or register for the services, product ordering, product selling, payment services and online transactions or other services of the Company, as well as, any legal entities, partnership groups which the Company is a contracting party or having legal relations;
5.4 To identify and verify the identity of the user for registration and access to the service;
5.5 To comply with the law and/or other necessity purpose of the legitimate interests pursued by the Company;
5.6 To fulfill other purposes as permitted by law to collect, store, use and disclose personal data without obtaining a consent from the data subject;
5.7 To provide after-sale services or services requested by you and to support, inform, respond and resolve any complaints;
5.8 To survey or evaluate your understanding, needs and satisfaction;
Disclosure of Personal Data
The Company shall not disclose your Personal Data to other persons or entities who are not an affiliate of the Company or third-party except for the fulfillment of purpose to collect, store, and process Personal Data as listed in this Notice, where the Company may disclose your Personal Data to the third-party as follows;
6.1 Logistic Service Providers;
6.2 Financial and Transaction Service Providers such as Commercial Banks, Payment Service Providers, etc.;
6.3 Insurance Issuers that you desire to use the service;
6.4 Any sectors that need to review the data management, whether internal or external, to prevent fraud;
6.5 Government sectors, Law enforcement Agencies, and Regulators;
6.6 Other sectors that processing the Personal Data for the purpose as permitted by law, such as an Agency that obeys a legal order, auditors or legal proceedings/litigations;
6.7 Any necessary third-party to enable the Company to perform its business and provide service to you, including any performances in accordance with the purposes, to collects and processing Personal Data, as stated in this Policy.
7.1.1 Period as required by the relevant laws (if any);
7.1.2 Statute limitation for legal action arising from or in connection with the documents or Personal Data collected by the Company; and
7.1.3 Practice of the Company and business sector for the Personal Data in each classification.
The Company will retain your Personal Data as long as the Company still owes the user a Service, if permitted by laws or such retention is necessary for establishment of legal claims of the Company.
7.2 After expiration of the above retention period the Company will delete, destroy or de-identify such Personal Data from its system and system of any other persons providing services to the Company (if any) save and except that the Company could continually retain such Personal Data as required by the Personal Data Protection Laws or other applicable laws. Privacy of Minors
The Company has no intention of collecting Personal Data from users under the age of 18. If any legal guardian is aware that your minor have given the Company their Personal Data, please contact the Company to give your consent for the use and access of Personal Data in accordance with this Policy. If the Company detects that we have collected Personal Data from persons under the age of 18 without the consent of their legal guardian, (if required) the Company will immediately remove such Users' Personal Data from the Company’s system.
10.1 Right to Access
You have the right to access to your Personal data and request the Company to extract a copy of such Personal Data to you subject to the Personal Data Protection Laws;
10.2 Right to Transfer
You have the right to obtain your Personal Data including to transmit or transfer your Personal Data to other Personal Data Controller or to you except that such request by nature is not possible and subject to the Personal Data Protection Laws;
10.3 Right to Object
You have the right to object the processing of your Personal Data as permitted by the Personal Data Protection Laws;
10.4 Right to Delete
You may ask the Company to delete, destroy or de-identify your Personal Data as permitted by the Personal Data Protection Laws;
10.5 Right to Suspend
You have the right to ask the Company to suspend the processing of your Personal Data as permitted by the Personal Data Protection Laws;
10.6 Right to Correct
You have the right to correct your Personal Data if it is incorrect, not current, incomplete or causes confusion;
10.7 Right to Revoke Consent
In case the Company processes your Personal Data based on your consent, you have the right to revoke such consent granted to the Company; and
10.8 Right to Complain
In case there is a ground to believe that the Company violates the Personal Data Protection Laws, you have the right to lodge a complaint with the expert committee appointed by the Personal Data Protection Commission in accordance with regulations and procedures set out by the Personal Data Protection Laws.
