Terms and Conditions

These are Terms & Conditions (the “Terms & Conditions”) for your use of the application owned, controlled and managed by Dee Doctor (Thailand) Co. Ltd (“Dr. Dee”), including Dr. Dee mobile application (the “Platform”, “our application”, “the application”)

These Terms & Conditions govern your use of our Platform and your conduct, regardless of the means of access. You may be using our interactive services (“Interactive Services”), such as our reviews and any services which we may introduce from time to time. These Terms & Conditions shall govern your use of the interactive services. We may engage with you on third party including social media webpages where we post content or invite your feedback, such as http://www.facebook.com/drdeethailand  and http://instagram.com/drdeethailand (“Social Media”). Our Terms & Conditions and other areas of our Platform provide guidelines (“Guidelines”) in connection with our Social Media and Interactive Services. We do not control those Social Media and these Terms & Conditions do not apply to companies that we do not own or control, or to the actions of people that we do not employ or manage.

If you do not agree or refuse to bond to any agreement and Terms & Conditions, please kindly stop visiting and using this Platform. We reserve the right to change, adjust or improve agreement and Terms & Conditions at all time without prior notice. Please frequently check agreement and Terms & Conditions of Platform usage. If you use the Platform after the change, adjustment or improvement of agreement and Terms & Conditions, we consider that you have implicitly accepted the change. 1.   Accessing the Platform

1.1 We cannot guarantee that the Platform will operate continuously or without interruptions or be error-free. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Platform is unavailable at any time or for any period. You must not attempt to interfere with the proper working of the Platform and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt the Site or any computer system, server, router or any other internet-connected device.

1.2 You agree that you shall only submit or provide information which is accurate and true, and that you will keep the information provided up-to-date.

1.3 To register, you must be over 18 years of age. By registering on the Platform, using the Platform and/or making a purchase or other services, you confirm and certify that the information you provide, included but not limited to, your date of birth is complete, accurate and up-to-date.

1.4 On registration for membership at our Platform, you will need a password for your account. You are responsible for ensuring your account details including your password remain confidential, current, complete and accurate. You are responsible for all activities that occur under your account and/or password (authorized or not) as if such activities were carried out by you. You shall notify us immediately if you become aware of or have reason for suspecting that the confidentiality of your account details including your password has been compromised or if there has been any un authorized use of your account or if your Personal Data requires updating.

1.5 We reserve the right to suspend or terminate your account without prior notice for any reason including if the Terms and Conditions are violated.

2.   Intellectual Property Rights

2.1  You may use the platform only in the manner permitted by the Terms & Conditions.

2.2  All intellectual property rights (including, without limitation, copyright, trademarks, patents, design rights, and all other forms of intellectual property rights existing in the world) in the Platform are owned by or licensed to the company and its affiliates. Nothing in the Terms & Conditions constitutes a transfer of any intellectual property rights.

2.3  Permission is granted to electronically download or print of copies of the material and information on the Platform for personal use, non-commercial use and information only. If you do download or print off copies of the material and information on the Platform, you must retain any copyright or other intellectual property notices contained in the original material.

2.4  Any other use of the material and information on the Platform including reproduction for purposes other than those permitted above, modification, distribution, republishing, transmission, display or performance without the prior written permission of the company is strictly prohibited.

3.   Eligibility

3.1 To be able to make purchases or use our services through the Platform, you will be required to provide us with your personal details. In particular, you will be required to provide us with your name, postal address, e-mail address and/or other contact details as indicated.

3.2 The information or personal details that you provide us shall be processed in accordance with our Privacy Policy in the context of your order. When you use our Platform, you agree to the processing of your information and details, and you confirm that all information and details provided by you are true and accurate. Furthermore, when you place an order through our Platform, you confirm that you are over the age of 18 years and are legally eligible to enter into binding contracts. If you are under 18 years of age, you may only place an order with the consent of your parent or guardian. If you do not have consent from your parent or guardian, you must stop using the Platform.

4.   Your User Generated Content

4.1   By submitting content other than your personal data to the Platform, you confirm that you have the right to use the same and a submission together with your agreement to these Terms & Conditions shall constitute an assignment to us of any intellectual property rights in such content. Any content you upload to the Platform will be considered non-confidential and non-proprietary, and we have the right to use, copy, remove, distribute and disclose to third parties any such content for any purpose including (but not limited to) use of such content at our own discretion (with or without accreditation) in any media

4.2  You confirm that content you upload to the Platform (including any photos, videos, reviews, comments, or other communication, information or content) does not contain anything that: (i) is distasteful, offensive, threatening, defamatory, misleading, defrauding or controversial, of bullying, harassing or otherwise objectionable behavior, (ii) infringes any intellectual property rights, privacy or other rights of any person,  (iii) otherwise does not comply with all applicable laws and regulations, and (iv) consist of or contain software viruses, political campaigning, commercial solicitation, spam, unsolicited commercial electronic messages or other material which may interfere with or disrupt our services.

4.3  We reserve the right (but not the obligation) to monitor, edit and/or remove any activity or content. We take no responsibility and assume no liability for any content posted by you or any third party.

4.4   You are responsible for all content that you upload, post, email or otherwise transmit via or to the Platform or through our Interactive Services or otherwise, including the submission of reviews and all other data, profile information, documents, text, software, applications, music, sound, photographs, graphics, video, messages, comments, questions, answers or other materials (collectively, “Content”). We will not accept Content from you unless you are a registered user of the Platform. By submitting Content to us, you represent and warrant that:

• You understand you are participating in a public forum and that your Content will be available to all other users of the Platform, the Interactive Services and potentially Social Sites;

• you are the sole author and owner of the intellectual property, and other, rights thereto (or have the necessary licenses, rights, consents and permissions to use and authorize Dr. Dee to use all intellectual property, and other, rights thereto to enable inclusion and use of the Content in the manner contemplated by the Sites and out Terms & Conditions);

5.   Third Party Links

Our Platform may include links with access to content from third party, such as links that will enable you to access the websites of third party directly. We do not control these third party websites and are not responsible for their use of your data. When you click through to these content and/or websites you may leave the area controlled by us, and we cannot accept responsibility for any issues arising in connection with either the third parties' use of your data, the content or the services offered to you by third parties. You therefore visit/access these contents and/or websites of third parties entirely at your own risk.

6.  Price and Payment

6.1   All Products prices listed are in Thai Baht (THB) and inclusive of Value added Tax (VAT) and other applicable charges, but exclude delivery costs. Delivery fees will be charged where applicable and will be included in the order total upon checkout. Prices or shipping are subject to change effective immediately upon posting of such price changes to the Platform or other form of notification.

6.2   Bill payment via bank transfer must be received within 2 days of placing the order, using the correct pay-in slip and reference numbers. If we do not receive payment within the above time frame, the order will be automatically cancelled and you will be informed. Alternatively, you may pay by any method that we provided, but in any event, we shall not be bound to supply or service before we have received cleared funds in full.

6.3   We reserve the right to change the payment terms for any order without prior notice. You are required to read and understand the payment terms before placing any order on the Platform.

6.4   If payment for any order has already been made but the order is not accepted by us, you will be entitled to a refund, depending on the period of time your financial institution needs to arrange the refund. We shall not be liable with respect to any loss, damage, cost or expense that you or any person may incur as a result of any delay in your financial institution processing the said refund.

7.  Cancellation, Returns and Refund Policy

7.1   Cancellation

7.1.1   We may cancel an order if the Product is not available for any reason or any other reasons

    which caused an order not able to be fulfilled. We will notify you if this is the case.

7.1.2   You cannot cancel an order once a Dispatch confirmation is issued. If you wish to seek further information or assistance, kindly contact us.

7.2   Return and Refund

7.2.1   You shall examine the products immediately upon collection / delivery for any deficiencies

and/or damages. If any product is found to be expired, missing, incorrect or damaged inside after receiving the order, Claims for return (if any) must be lodged via the return request section of the Platform, within the next 14 days from the date of delivery, otherwise we shall have the discretion to refuse your request and claims. After 14 days from the date of delivery, all requests for refund will be reviewed on case by case basis and subjected to our approval.

7.2.2   Exchange of the Product or refund for the Product can be arranged for the following reasons:

·  If the Product is obviously expired/damaged at time of delivery.

·  If the Product is expired/damaged inside packaging after collection/delivery; and you contact us within 14 days.

7.2.3   We reserve the rights to reject any refund for opened or used Products. We shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

7.2.4   Products returned for a refund shall be refunded at the price which you had paid at the point of ordering

8.  Title and Risk

8.1   Once delivered, the Products ordered will become your responsibility and, except in relation to Products that are damaged or faulty when delivered or have been incorrectly delivered, we will not accept any liability for their loss, damage or destruction after they have been delivered.

8.2   You agree that you shall only submit or provide information which is accurate and true, and that you will keep the information provided up-to-date.

9.   Disclaimer and Limitation of Liability

9.1   To the extent permitted by law, we are providing the Platform, Contents and the Interactive Services on an as-is basis and makes no representations, conditions or warranties of any kind, express or implied, with respect to the operation of the Platform or Interactive Services, the information, content, materials or products, included on the Platform. You should not act on any data or information posted on the Platform without first independently verifying its contents.

9.2   We will not be liable for any claim arising out of your incorrect or improper use of any or any goods, products or services offered by or purchased through the Platform, including use that does not comply with any product instructions or that would be otherwise unexpected or unreasonable.

9.3   To the extent permitted by law, We will not be liable for any damages of any kind arising from the use of any site, or from any information, content, materials, products or other services included on or otherwise made available to you through any of our Platform including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

10.   GOVERNING LAW

10.1  The Terms & Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed in accordance with the law of Thailand, without giving effect to any principles of conflict of laws.
